General Terms and Conditions of Sale

ARTICLE 1. OBJECT

1.1 Scope of Application

These general terms and conditions of sale determine the rights and obligations between Drop-Cube, represented as a sole trader under the trade name Drop-Cube, and any consumer or professional client making a purchase on the website www.drop-cube.com.

1.2 Offered Products

Drop-Cube sells cubic dioramas inspired by the geek universe. These products are crafted, providing a unique experience for consumers passionate about various genres.

ARTICLE 2. ORDER

2.1 Order Placement

The placement of an order on the website www.drop-cube.com implies the full and unconditional acceptance of these general terms and conditions of sale. The ordering process includes product selection, cart validation, choice of payment method, and final order confirmation.

2.2 Order Confirmation

The order confirmation is sent by email to the address provided by the consumer. It summarizes all elements of the order, including product specifications, total price, delivery costs, and contact details for customer service.

ARTICLE 3. PRICE

3.1 Product Pricing

The prices of products on the website www.drop-cube.com are indicated in euros, inclusive of all taxes, excluding delivery charges. Drop-Cube reserves the right to modify prices at any time while ensuring the application of rates in force at the time of order validation.

3.2 Delivery Costs

Delivery costs, not included in the product prices, are calculated during order validation. Drop-Cube reserves the right to adjust them based on current conditions and specific delivery modalities.

3.3 Payment

The full payment must be made at the time of order. Drop-Cube accepts payments by credit card, SEPA bank transfer, and PayPal. Credit card payments pass through a secure system, ensuring the confidentiality of consumer data.

ARTICLE 4. DELIVERY

4.1 Delivery Process

Delivery is carried out exclusively by postal services within 5 working days. For custom dioramas, a creation period of 7 days commences after the client's payment. This involves the creation of a pattern, client validation, a 5-day crafting process, and finally, delivery. The entire process ensures meticulous attention to detail, especially for personalized dioramas inspired by various geek universes.

4.2 Delivery Terms for Custom Dioramas

For custom dioramas, the specific process is as follows:

Pattern Creation: After the customer's payment, Drop-Cube initiates the creation of a pattern, a process that takes approximately 7 days. Pattern Validation by the Client: Once the pattern is created, the customer is invited to validate it. This process depends on the client and may vary in terms of timing. Creation and Delivery: Once the pattern is validated, the creation of the diorama takes an additional 5 days, after which the product is shipped and delivered within 5 business days.

4.3 Delivery Charges

Delivery charges, not included in the product prices, are calculated during the order validation. Drop-Cube reserves the right to adjust them based on current conditions and specific delivery terms.

4.4 Order Tracking

The consumer can track the progress of their order by logging into their account on the website www.drop-cube.com

4.5 Order Receipt

It is the consumer's responsibility to check the status of the order upon receipt. In case of missing, damaged, or non-compliant products, the consumer must inform Drop-Cube as soon as possible to enable the prompt handling of the complaint.

ARTICLE 5. RECEIPT AND CLAIMS

The consumer is obliged to check the condition of the packaging and the conformity of the delivered product. In the event of apparent damage to the packaging or non-conformity of the product, the consumer must issue written reservations on the delivery note and inform Drop-Cube within 48 hours of receiving the package, by email at dropcube.contact@gmail.com.

After this period, no claims will be considered. Drop-Cube reserves the right to request photographs of the damaged product to facilitate the processing of the claim.

Drop-Cube undertakes to replace the damaged or non-conforming product as soon as possible, subject to availability. If replacement is not possible, Drop-Cube will proceed with the refund of the affected product. Return costs in the case of a claim will be covered by Drop-Cube.

In the case of non-conformity or non-apparent damage, the consumer must inform Drop-Cube within 7 days of receiving the product by email at dropcube.contact@gmail.com. Any exceedance of this deadline will invalidate any claim.

Drop-Cube undertakes to examine any claim as soon as possible and to find a satisfactory solution for the consumer.

ARTICLE 6. RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Article L121-20 of the Consumer Code, the consumer has a period of fourteen clear days to exercise their right of withdrawal without having to justify reasons or pay penalties. This right applies, with exceptions, notably in the case of the supply of goods made to the consumer's specifications, clearly personalized products, goods liable to deteriorate rapidly, or non-returnable products once opened.

Any return must be previously notified to Drop-Cube's Customer Service.

Return procedures are specified below. The right of withdrawal is exercised without penalty, except for return costs, which remain the responsibility of the consumer, as well as shipping costs, if applicable. In the event of exercising the right of withdrawal, the consumer can choose between a refund of the amounts paid, an equivalent exchange, or a bank supplement if applicable. Shipping and/or return costs will be deducted from the refund made by Drop-Cube.

Products subject to withdrawal must be returned to Drop-Cube in a new condition and suitable for resale. Any damaged, incomplete, or product with original packaging damaged or missing will not be refunded or exchanged. Drop-Cube undertakes to make the refund as soon as possible and at the latest within 30 days following the withdrawal.

Drop-Cube recommends that the consumer return products with additional recommendations or insurance to ensure compensation for products in the event of loss or pilferage of the package. Any withdrawal exercised after the fourteen-day period will be refused by Drop-Cube.

Any product return must be subject to prior agreement from Drop-Cube and comply with the conditions set out by the After-Sales Service (SAV). Without prior agreement and/or non-compliance with the return conditions, any package will be refused by Drop-Cube and returned at the sender's expense.

Upon receipt of the return request, made exclusively by email to dropcube.contact@gmail.com with the subject "Return Request," the customer must explain the reasons for the return and provide the order number and date. The return of a product is possible after analysis and agreement from Drop-Cube, and this agreement is valid for 5 working days. In the case of a delivery error or non-compliant receipt, Drop-Cube may provide a prepaid label for the return of the product.

Any product for exchange or refund must be returned to Drop-Cube within five working days following the return agreement, in its original packaging and in perfect condition, to the following address:

The granted return number must be clearly indicated on the return packaging. Any return must be previously notified to Drop-Cube's Customer Service. In the event of non-compliance with the procedures mentioned above, no claim for non-compliance or apparent defect of the delivered products will be accepted.

Drop-Cube will refund the return shipping costs only if its responsibility is engaged and if the product taken back corresponds to the original declaration made by the consumer and confirmed by the SAV.

Article 7. PAYMENT TERMS

The total payment must be made at the time of the order. Amounts collected cannot be considered as down payments or installments. Drop-Cube reserves the right to refuse any delivery or order from a consumer with outstanding payments or payment disputes.

The consumer can settle purchases by credit card, SEPA bank transfer, or PayPal. Credit card payments are subject to the same collection conditions, except for specific payment offers available on the website www.drop-cube.com. Orders paid by bank transfer will only be processed upon receipt of payment. Availability and shipping times will be recalculated from the date of payment registration.

Drop-Cube reserves the right to suspend any order management or delivery in case of payment authorization refusal by financial institutions. All credit card payments pass through a secure Payline system, ensuring that the credit card number is not retained in Drop-Cube's files. ARTICLE 8: SECURITY OF PAYMENT ON THE WEBSITE 

The transaction procedures on the www.drop-cube.com website are carried out in collaboration with highly secure payment service providers, Payline and PayPal. As experts in payment security, Payline and PayPal ensure that sensitive data is transmitted and stored according to the highest security and quality standards.

All transaction fees, including commissions from various financial institutions, are fully covered by Drop-Cube. Therefore, the consumer's payment is effectively managed by leading online payment specialists.

The online payment solutions chosen by Drop-Cube and offered on the www.drop-cube.com website guarantee:

  • Confidentiality and protection of transactions and data using SSL or SET technologies, ensuring no sensitive information is transmitted in plain text over the network.

  • Confidentiality of payment data, including credit card numbers.

  • Assurance that Drop-Cube or Drop-Cube applications never have access to the consumer's credit card number.

Furthermore, all communications between the consumer's internet browser and Payline or PayPal are encrypted using 128-bit SSL encryption. It is not possible for the customer to use a web browser that does not support this encryption technique. Payline and PayPal are protected by various firewall systems and protocol conversions to prevent unauthorized access to data or payment processors by unwanted visitors.

ARTICLE 9: WARRANTIES AND AFTER-SALES SERVICE (SAV)

Drop-Cube informs its consumers that most suppliers require the retention of original packaging to qualify for warranty coverage. In the case of a defective product during the warranty period, the consumer is encouraged to contact Drop-Cube's customer service, which will provide instructions for returning the product. No returns will be accepted without prior agreement, evidenced by the issuance of a return number and an agreement voucher, valid for ten working days.

In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, these provisions do not exempt the consumer from the legal guarantee obliging the professional seller to guarantee against hidden defects. Drop-Cube reminds the consumer that after-sales service may extend up to ten weeks.

The manufacturer's warranty conditions and duration are those specified on the product sheets presented on the www.drop-cube.com website at the time of ordering and possibly on the warranty voucher accompanying the product(s). For warranties involving on-site interventions or direct manufacturer repairs, Drop-Cube recommends that the consumer check the type of warranty with Customer Service and/or the manufacturer before requesting a return authorization.

All costs and risks associated with the return of the defective product are borne by the consumer, who must return the product with the warranty coupon if required for a warranty repair.

Drop-Cube guarantees the consumer against hidden defects in the delivered products, offering replacement of defective products, or a refund, without being held responsible for any potential harmful consequences of these hidden defects.

ARTICLE 10: LIABILITY

As an entrepreneur operating under the trade name Drop-Cube, Drop-Cube has an obligation of means throughout all stages, from accessing the www.drop-cube.com site to delivery and after-sales service.

Drop-Cube's liability cannot be engaged for inconveniences or damages resulting from the use of the Internet, including service interruption, external intrusion, computer viruses, or any event qualified as force majeure.

Drop-Cube cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, resulting from the malfunction or misuse of the products sold. Drop-Cube's liability is limited to the amount of the order and cannot be invoked for minor errors or omissions that may have occurred despite all precautions taken in presenting the products.

Drop-Cube cannot be held responsible for indirect damages, loss of business, profit, or turnover, occurring in any way whatsoever.

In the event of non-performance of the contract due to stockout, force majeure, or disruptions such as strikes, floods, fires, pandemics, etc. (non-exhaustive list), Drop-Cube cannot be held responsible. Information provided by consumers on the www.drop-cube.com site is confidential, will not be disclosed to third parties, and will be used only for order processing and to personalize communication, including newsletters, as well as for customizing the site based on observed consumer preferences.

ARTICLE 11: COPYRIGHT

The use of the www.drop-cube.com site, owned by Drop-Cube, is subject to compliance with the above general conditions. The texts, illustrations, layouts, and other constituent elements on the site are protected by copyright or specific rights.

Any non-commercial and advertising use of information from the www.drop-cube.com site is authorized with proper source citation, after prior agreement with Drop-Cube. Reproduction for commercial and advertising purposes is strictly prohibited without prior request, with all inquiries to be addressed to Drop-Cube's customer service at dropcube.contact@gmail.com.

Drop-Cube allows the creation of links to the homepage or any other page without prior request. However, the use of data from the Drop-Cube site on another site must not be concealed or cause confusion about the origin of the information and requires written authorization from Drop-Cube. Any such requests should be addressed to dropcube.contact@gmail.com. These conditions apply during the period of online services and products offered by Drop-Cube on the www.drop-cube.com site.

The European Commission provides an online dispute resolution platform (ODR) available at http://ec.europa.eu/consumers/odr/. As a customer, you always have the option to contact the European Commission's arbitration board. We are neither willing nor obliged to participate in a consumer arbitration procedure.
